  • Direct Criminal Appeals

    Any person who has been convicted of a crime in Pennsylvania has an absolute constitutional right to appeal that conviction to a higher court. This is known as a “direct appeal.” A direct appeal is the first step in challenging an unfair or unlawful conviction or sentence and most often involves claims that the trial judge made mistakes before or during trial or at sentencing.

  • Post-Conviction Litigation

    If the issues raised on direct appeal do not result in relief, or only result in partial relief, a person convicted of a crime in Pennsylvania has a rule-based right to collaterally challenge their conviction and/or sentence under Pennsylvania’s Post-Conviction Relief Act. This avenue of relief, which is governed by extremely complex procedural and jurisdictional rules, most often involves claims that the defendant’s previous attorney or attorneys provided ineffective assistance of counsel which rendered the trial fundamentally unfair.
